The terms and conditions governing your use of the TouchDrop platform.

Acceptance of Terms
By accessing or using the TouchDrop platform, including our website, Shopify application, and any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform. These terms constitute a legally binding agreement between you ("Merchant", "you", or "your") and TouchDrop ("we", "us", or "our").
Service Description
TouchDrop is a direct-mail automation platform designed for Shopify merchants. Our service enables you to design, print, mail, and track physical postcard campaigns to your customers. This includes audience segmentation based on your Shopify store data, postcard design tools and templates, print fulfilment through our Australian print partner, and campaign performance tracking with attribution analytics.
Account Responsibilities
As a merchant using TouchDrop, you are responsible for:
- Maintaining the accuracy and completeness of your account information
- Ensuring the accuracy of customer data and mailing addresses used in campaigns
- Reviewing and verifying all uploaded artwork and creative assets before approving them for print
- Keeping your Shopify store integration active and permissions up to date
- Safeguarding your account credentials and notifying us promptly of any unauthorised access
Payment Terms
TouchDrop operates on a subscription billing model with per-card postage charges:
- Subscription fees are billed on a monthly or annual basis, depending on your selected plan
- Per-card postage and printing charges are deducted from your prepaid wallet balance when campaigns are submitted for printing
- All prices are quoted and charged in Australian Dollars (AUD)
- Payment processing is handled securely through Stripe
- You are responsible for maintaining a sufficient wallet balance to cover campaign costs
Intellectual Property
All artwork, creative assets, logos, and brand materials you upload to TouchDrop remain your intellectual property. You retain full ownership of your content.
By uploading content to TouchDrop, you grant us a non-exclusive, royalty-free licence to use your artwork and creative assets in our own promotional and marketing materials (for example, showcasing campaign examples on our website or in case studies). If you do not wish for your materials to be used in this way, please contact us at support@touchdrop.com.au to opt out.
Print Quality & Liability
TouchDrop provides a print preview for every campaign. By selecting "Ready" and approving your campaign for print, you confirm that the design, data, and content are correct. This serves as your sign-off on the final output.
- If the final printed output differs from the approved preview due to a misprint on the printer's end, TouchDrop and our print partner (SmartComm) bear responsibility and will reprint or credit the affected postcards
- If the data or artwork you uploaded was incorrect or contained errors that were present in the approved preview, TouchDrop is not liable for the resulting print output
- Delivery is provided on a best-effort basis — once data is submitted to our print partner, TouchDrop targets shipping 95%+ of postcards within 3 business days, but we are not liable for postal delays or issues beyond our control
Acceptable Use
You agree not to use TouchDrop for any of the following:
- Sending offensive, threatening, defamatory, or discriminatory content
- Distributing illegal, fraudulent, or misleading materials
- Violating any applicable Australian federal or state laws, including the Spam Act 2003, Privacy Act 1988, and Australian Consumer Law
- Sending unsolicited commercial mail to individuals who have not consented to receive it, where consent is required by law
- Using the platform in any way that could damage, disable, or impair the service
We reserve the right to review campaign content and suspend or terminate accounts that violate these acceptable use requirements.
Data & Privacy
Your use of TouchDrop is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data and your customers' data. Please review our Privacy Policy carefully.
Cancellation & Termination
- You may cancel your TouchDrop subscription at any time through your account settings or by contacting us
- Upon cancellation, your access will continue until the end of your current billing period
- TouchDrop reserves the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or misuse the platform
- Upon termination, your stored data will be handled in accordance with our Privacy Policy
Limitation of Liability
The TouchDrop platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:
- TouchDrop makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the service
- TouchDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
- Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid to TouchDrop in the 12 months preceding the claim
- TouchDrop is not responsible for the actions or omissions of third-party service providers, including postal services and print partners, beyond what is described in the Print Quality & Liability section above
Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or through a notice on the platform. Your continued use of TouchDrop after such changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Australia. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
